軟硬體之智慧財產權使用管理要點 Guidelines for the Use and Management of Software and Hardware Intellectual Property Rights

一、 國立雲林科技大學圖書館(以下簡稱本館)為維護本館網路設備及網路使用環境、複印設備軟硬體之智慧財產權使用,特訂定國立雲林科技大學圖館軟硬體智慧財產權使用管理要點(以下簡稱本要點)。

二、 本要點所稱讀者包括本校教職員工生及校外人士,均應依本要點之規定。

三、 為使本館網路維持順暢,禁止讀者使用本館網路做為傳送非法及威脅性的、猥褻性及傳送大量非法資料。

四、 本館網路上所可存取到之任何資源,皆屬本館所有,除非已正式開放或已獲授權使用,本館網路使用者禁止使用此資源。

五、 禁止使用本館網路設備做為干擾或破壞網路上其它使用者,如散佈電腦病毒、嘗試侵入未經授權之電腦系統或其它類似之情形者皆在禁止範圍內。

六、 禁止讀者使用本館網路電腦設備無故輸入他人帳號密碼、破解使用電腦之保護措施或利用電腦系統之漏洞入侵他人之電腦或其相關設備。

七、 禁止利用本館校園網路從事任何未經本館許可之商業性行為。

八、 嚴禁讀者未經允許自行設定本館網路IP位址。

九、 嚴禁讀者使用複製及轉製本館所有視聽資料、影音教材資料。

十、 個人私有之視聽資料欲使用本館器材放映時,需遵守下列規定:

(一)依著作權法,所攜帶之資料應為合法、公開播映版且有新聞局認可之許可證號或核准字號、加蓋鋼印之資料,方可使用。
(二)家庭播映用版之資料,禁止於本館放映使用。

十一、 使用本館之設備,重製任何資料應該徵求著作權人之同意,並於合理使用範圍內,掃瞄數量亦應注意合理之比例。

十二、 違反本要點者,必須依本校相關法令規範處理,如有違反法律者,需依「民法」、「刑法」、「著作權法」或其他相關法令負法律責任。

十三、 本要點經圖書館館務會議通過後,陳請 館長核准後施行,修正時亦同。

  1. Purpose
    To protect the intellectual property rights related to the software and hardware used in the network and copying equipment of the Library of National Yunlin University of Science and Technology (hereafter referred to as "the Library"), and to ensure a safe and lawful network environment, these "Guidelines for the Use and Management of Software and Hardware Intellectual Property Rights" (hereafter referred to as "the Guidelines") are hereby established.

  2. Scope of Users
    The Guidelines use the term "reader" to refer to all users, including the university's faculty, staff, students, and external visitors, who must comply with these provisions.

  3. Network Conduct
    To maintain stable and efficient network operations, users are prohibited from using the Library's network for transmitting illegal, threatening, obscene, or large volumes of unauthorized data.

  4. Access Restrictions
    All resources accessible via the Library's network are the property of the Library. Unless officially made available or authorized, users are prohibited from accessing or using such resources.

  5. Prohibited Activities
    Users are forbidden from using Library network equipment to interfere with or damage other users' systems, including spreading computer viruses, attempting unauthorized access to computer systems, or other similar actions.

  6. Account Security
    Users must not input others' account credentials, bypass system protections, or exploit system vulnerabilities to invade others’ computers or related devices.

  7. Commercial Use
    Users may not engage in any commercial activity via the Library's campus network without prior authorization from the Library.

  8. Network Configuration
    Users are strictly prohibited from altering or setting the Library's network IP addresses without permission.

  9. Copying Restrictions
    It is forbidden to copy or duplicate any audiovisual materials or multimedia instructional resources owned by the Library.

  10. Use of Personal AV Materials
    When using personal audiovisual materials on Library equipment, users must comply with the following:

          (1) According to the Copyright Act, the materials must be legal, authorized for public broadcasting, and carry an official approval 
          number from the Government Information Office, along with a certified stamp.
          (2) Materials labeled for "home use only" are not permitted for public screening in the Library.

  1. Reproduction of Materials
    When using Library equipment to reproduce any materials, users must obtain permission from the copyright holder and ensure use falls within the scope of fair use. The quantity of scanned content must also be reasonably limited.

  2. Violation and Liability
    Any violation of these Guidelines will be dealt with according to the University's relevant rules and regulations. If a legal breach occurs, the violator shall bear full responsibility under the Civil Code, Criminal Code, Copyright Act, or other applicable laws.

  3. Implementation and Amendments
    These Guidelines shall be implemented upon approval by the Library Affairs Meeting and approval by the Library Director. The same applies to any amendments.
